2 What This Policy Covers

This policy covers information collected through our website, audit and contact forms, consultation bookings, email and other communications with prospective clients and client representatives.

For these activities, we decide how and why personal information is used. Where applicable law uses that term, we act as the data controller.

If we process personal information from a client’s Amazon account solely to carry out the client’s instructions, our responsibilities are also governed by the relevant service agreement and any required data processing agreement. That processing does not give us permission to use the client’s customer information for unrelated purposes.

3 Information We Collect

Information you provide

Depending on how you interact with us, you may provide:

  • Your name, work email address, phone number and role.
  • Your brand or store name, Amazon storefront URL, ASIN or product links, and product category.
  • Business information such as monthly advertising spend, revenue range, marketing goals and the help you need.
  • Consultation details, messages, documents and other information you choose to send.

You can browse our public pages without submitting an inquiry. If you choose not to provide information needed for an audit or appointment, we may be unable to complete that request.

Information needed for client services

If you engage us, we may receive information needed for the work you authorize, such as campaign reports, keywords, budgets, sales and conversion metrics, listing content, inventory information, compliance documents and account permissions. If we invoice you, we may also keep billing contact details, invoices and payment records.

Do not send your Amazon password, authentication codes or full payment card details through an inquiry form or ordinary email. For a deeper account review, we use the official Amazon permissions process described on our audit page. You remain in control of the access you grant, and you can withdraw it at any time in Seller Central.

Please remove customer names, contact details and other unnecessary personal information from reports or screenshots before sending them to us. Our website forms are not intended to collect medical records, government identification numbers or information about an individual’s health.

Technical information

Our website and its service providers may receive technical information such as your IP address, browser and device type, referring page, pages requested and access times. This information can be used to deliver the website, diagnose errors and protect it against misuse. Additional information collected through cookies or similar technologies is addressed in section 8.

4 Where Information Comes From

We receive information directly from you through forms, bookings, email, calls and other communications. We may also receive information from someone authorized to act for your business, from an account you authorize us to access, and from publicly available business sources such as your Amazon listings or brand website.

Our consultation booking link uses Jotform. When you submit that form, the details you enter are made available to AKSpire through that service. Website hosting and other technical providers may also supply operational logs.

If you provide another person’s information, please ensure you are authorized to do so and direct them to this policy.

5 How We Use Your Information

We use information for purposes connected with your interaction with us, including to:

  • Respond to questions and arrange consultations.
  • Prepare and deliver the audit you request, including related communications.
  • Assess the service you need and prepare a proposal when you ask for one.
  • Provide agreed services, manage account access and communicate about your project.
  • Manage invoices, business records and contractual obligations.
  • Operate, maintain and protect our website and investigate misuse.
  • Meet legal obligations and establish, exercise or defend legal claims.

An audit or consultation request does not automatically subscribe you to a marketing list. Any separate promotional communications must follow applicable marketing rules and the preferences you have given us. You can ask us to stop promotional messages at any time using the instructions in the message or by emailing support@akspire.com. Necessary service communications may continue.

7 When We Disclose Information

We do not sell the information you submit in an audit, consultation or contact request. We may disclose information where necessary to deliver the requested service or run our business, including to:

  • Service providers supporting website hosting, form processing, email, document storage, scheduling or other agreed business functions. Jotform is used for our consultation booking form.
  • Team members and contractors who need information to carry out the work you authorize.
  • Amazon or other platforms where disclosure is needed for an action you authorize, such as managing a campaign or resolving a listing issue.
  • Professional advisers, and a payment provider if used for your agreed billing method.
  • Authorities or other parties when disclosure is legally required or necessary to protect rights, investigate fraud or address security issues.

A proposed merger, acquisition or transfer of our business may require relevant records to be disclosed to advisers or a successor, subject to applicable legal protections and any required notice.

Disclosures to providers should be limited to the information needed for their function and subject to appropriate confidentiality and data protection requirements. A provider may also process certain information for its own purposes under its own privacy notice. Tracking disclosures, including any legally defined sale or sharing, must be specified in section 8.

8 Cookies and Similar Technologies

Cookies are small files stored on your device. Similar technologies can include pixels, local storage and identifiers used by website tools or embedded services. Their use depends on the features and providers enabled on the website.

Necessary technologies may support functions such as website delivery, security and form submission. If enabled, analytics technologies can help measure how visitors use the website. If enabled, advertising technologies can measure campaigns or support advertising to people who have visited the site.

You can manage or delete cookies through your browser settings. Blocking certain technologies may affect website functions. Where consent is legally required, the relevant technologies must be held until consent is given, and you must be able to withdraw that consent. A privacy policy alone does not provide a technical consent or opt-out control.

Some privacy laws treat disclosures to advertising providers as a sale or sharing of personal information, even when no money is paid. An ordinary browser cookie setting may not exercise every legal opt-out right.

9 How Long We Keep Information

Retention depends on why information was collected. Inquiry, audit and booking records may be retained while a request is active and for a reasonable period needed to handle related questions or disputes. Client records may be retained for the engagement and afterwards where needed to meet contractual, accounting, tax or other legal requirements.

Technical logs may be retained as needed to investigate errors and security incidents. Cookie and tracking retention must be disclosed in section 8. A legal hold or unresolved claim can require records to be kept longer.

We use these purposes, the sensitivity of the information and applicable obligations to determine retention. Information should be deleted or anonymized when it is no longer needed. Copies in backups may remain until the relevant backup is replaced or expires, with access restricted in the meantime.

10 Information Security

We use reasonable administrative and technical measures designed to protect personal information against unauthorized access, loss, misuse and disclosure. Access should be limited to people who need it for an authorized purpose.

No website, email system or storage method can guarantee absolute security. Please use the agreed transfer method for confidential client documents, and avoid including sensitive information that is unnecessary for the request. If a security incident triggers a legal notification obligation, we will provide the required notification.

11 International Processing

Our website serves businesses in the United States. Information may be accessed or stored in other countries where our team or service providers operate. Those countries may have different privacy laws.

Where required, international processing must be subject to the safeguards prescribed by applicable law. Contact support@akspire.com with questions about where your information is processed.

12 Your Privacy Choices and Rights

You can ask us to review information we hold about you, correct inaccurate information, delete information that is no longer needed, or stop promotional communications. Statutory rights and exceptions depend on where you live, the information involved and whether the relevant law applies to our processing.

Where applicable, your rights may include access, a copy in a portable format, correction, deletion, restriction of processing, objection to certain processing, withdrawal of consent, and opting out of targeted advertising or the sale or sharing of information.

To make a request, email support@akspire.com with the subject Privacy Request and describe what you would like us to do. You may also contact us by phone at +1 332 291 0306. Provide enough information for us to locate the relevant records, but do not send passwords or sensitive identity documents unless a necessary and secure verification process has been agreed.

We may need to verify your identity or an authorized representative’s permission before acting on certain requests. Verification must be proportionate to the request. We will respond within the time required by applicable law and explain any applicable exception or refusal. If the law provides an appeal right, you can contact us at the same email address to appeal our decision.

United States privacy rights

Where an applicable state privacy law covers our processing, including the California Consumer Privacy Act as amended, eligible residents may have rights to know the categories and specific information collected, its sources, purposes and disclosures; correct or delete information; and opt out of legally defined sale or targeted advertising. Some laws also provide rights concerning sensitive information or certain profiling activities.

Where provided by law, you may use an authorized agent and must not be unlawfully discriminated against for exercising your rights. Tracking opt-out methods and the handling of recognized browser signals must be described accurately in section 8.

European and United Kingdom privacy rights

If European or UK data protection law applies to the relevant processing, you may also have the applicable rights to object, restrict processing, obtain portability and complain to your local supervisory authority. Contact us if you need information about the legal ground for a particular activity or an applicable international transfer safeguard.

13 Children

Our website and services are intended for business users and adults. We do not knowingly collect personal information from children under 13 through our website. If you believe a child has provided information, contact support@akspire.com so we can investigate and delete it where appropriate. We will also follow any other child privacy requirements that apply.

14 Third Party Websites and Services

Our website includes links to services such as Amazon and Jotform and may load resources from external providers, such as fonts. Visiting an external service or loading an external resource can disclose technical information to that provider. Its own privacy notice describes its independent processing.

Jotform’s privacy notice is available at https://www.jotform.com/privacy/. This does not replace AKSpire’s responsibility for the information we receive and use from our consultation form. Please review the relevant third party notice when using an external service.

15 Changes to This Policy

We may update this policy when our practices, services or legal obligations change. We will post the revised version on this page and update the last updated date shown at the top. Where required, we will provide additional notice of a material change or obtain consent before carrying out new processing that requires it.
